Legislation & Rules

The practice and procedure of the Court of Appeal is governed by legislation and decisions of the courts.

Procedure in civil matters is governed by the Court of Appeal Act, the Court of Appeal Rules, case law, practice directives issued by the Chief Justice and practice notes issued by the Registrar.

Procedure in criminal matters is governed by the Criminal Code, the Court of Appeal Criminal Appeal Rules, case law, practice directives issued by the Chief Justice, and practice notes issued by the Registrar.

Other statutes and rules may govern in specific situations, such as extradition and appeals and reviews from administrative bodies.

PRACTICE DIRECTIVE - FIVE JUSTICE DIVISIONS

The Court of Appeal has revised its civil and criminal Practice Directive titled "Five Justice Divisions." The only change is to shorten the time for a request for a five justice division from two months to six weeks. The change is effective immediately. A copy of the new directive may be found here.

Practice Directive: Expedited Appeals

The Court of Appeal has released a new civil and criminal Practice Directive titled "Expedited Appeals," which is effective immediately. A copy of the new directive may be found here.

Amendment to Court of Appeal Rule 33 (General requirements for applications to a justice):

Commencing immediately, Court of Appeal Rule 33 has been amended to provide for 5 days' notice on general applications before a justice in chambers. The Rule has also been amended to provide for a 2 day response by the responding party, as well as setting out the filing requirements for the responding party. Here is the Order in Council. In addition, Form 6 has been amended to include a statement indicating whether the application is contested or uncontested.

REVISED PRACTICE DIRECTIVES & PRACTICE NOTES - EFFECTIVE SEPTEMBER 19, 2011

Effective 19 September 2011, the Court of Appeal will repeal and reissue its Practice Directives and Practice Notes. Click here for the details of the change. Both the old and new Practice Directives and Practice Notes may be found below.
